These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and PriceScout LLC, a California limited liability company ("PriceScout," "we," "us," or "our"). These Terms govern your access to and use of the PriceScout website located at usepricescout.com (the "Site"), any associated browser extension (the "Extension"), and all related services, features, content, and functionality offered by PriceScout (collectively, the "Service").
By accessing or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately cease all use of the Service.
We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Service after any such modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
PriceScout is a price intelligence platform that provides consumers with comparison pricing information to assist in making informed purchasing decisions. The Service allows you to submit a product URL from a supported retailer, after which PriceScout will:
The Service is provided free of charge. No account creation, login, subscription, or payment is required to access the core features of the Service.
The Service is intended for use by individuals who are at least eighteen (18) years of age or the age of majority in their jurisdiction of residence, whichever is greater. By using the Service, you represent and warrant that you meet this eligibility requirement. The Service is not directed to children under the age of thirteen (13), and we do not knowingly collect information from children under 13 in accordance with the Children's Online Privacy Protection Act (COPPA).
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, in accordance with these Terms. You may use the Service to look up pricing information for products you are personally considering purchasing.
You agree not to engage in any of the following activities in connection with the Service:
We reserve the right, in our sole discretion, to restrict, suspend, or terminate your access to the Service at any time and for any reason, including for violation of these Terms, without prior notice or liability.
The pricing information displayed on the Service is retrieved from third-party retailer websites and cached by PriceScout. This cached data is refreshed periodically, approximately every six (6) hours. Because prices on retailer websites may change at any time, the prices displayed on the Service may not reflect the exact price available on a retailer's website at the moment you visit that retailer. PriceScout does not claim or represent that the pricing data displayed on the Service is real-time, and you should always verify the final price on the retailer's website before completing a purchase.
Price verdicts (Good Deal, Fair Price, Overpriced, Best Price Available, and Can't Compare) are generated by comparing the submitted product's price against prices currently available at other tracked retailers, using defined percentage thresholds. Verdicts represent a point-in-time comparative assessment based on the cached pricing data available at the time of the query. They do not reflect longer-term price history, historical lows, or future price projections. A verdict is not a recommendation to buy or not buy a product. It is informational only.
Sale predictions displayed on the Service indicate upcoming known sale events that may be relevant to a product's category. These predictions are based on a hardcoded calendar of annual sale events and general historical discount patterns for product categories. They are estimates only and do not constitute a guarantee or promise that: (a) a particular sale event will occur; (b) a particular product will be discounted during a sale event; (c) a specific discount amount will be offered; or (d) the product will be available at any particular price in the future. PriceScout expressly disclaims any liability for sale predictions that do not materialize.
PriceScout tracks a selection of major U.S. retailers. We do not claim to compare every retailer, marketplace, or source where a product may be available. The absence of a retailer from our results does not mean that retailer does not carry the product or that a lower price does not exist elsewhere. The Service is a tool to assist your purchasing decisions, not a comprehensive or exhaustive source of all available prices.
The links to retailer product pages displayed on the Service are affiliate links. When you click on a link and subsequently make a purchase on the retailer's website, PriceScout may earn a commission from the retailer. This commission is paid by the retailer, not by you. Clicking an affiliate link does not increase the price you pay for any product.
Every product result link on the Service is a potential affiliate link — not just selected or highlighted results. PriceScout may earn a commission on any result you click, regardless of whether it is the cheapest option, the most expensive, or anywhere in between.
Affiliate commissions and commercial relationships with retailers or affiliate networks do not influence which results are displayed on the Service, the order in which results are ranked, or the price verdict assigned to any product. Results are always ordered by price, lowest first. In the event that two or more retailers offer the same price, results are ordered alphabetically by retailer name. This ordering logic is rule-based and is not subject to override by any commercial consideration.
If the lowest price available carries no affiliate relationship, that result will still be displayed first. PriceScout's mission is to show you the lowest available price regardless of whether PriceScout earns a commission on that result.
PriceScout participates in affiliate programs and networks including, but not limited to, Amazon Associates, Impact.com, Commission Junction (CJ Affiliate), ShareASale, Rakuten Advertising, and FlexOffers. Each of these programs has its own terms and conditions that govern PriceScout's participation. The Service contains links to third-party websites, including retailer websites. These links are provided for your convenience and informational purposes. When you click an affiliate link and are directed to a retailer's website, you leave the Service and become subject to that retailer's terms of service and privacy policy. PriceScout does not control, endorse, or assume responsibility for the content, products, services, privacy practices, or policies of any third-party website. Your interactions with any third-party website, including the purchase of products, are solely between you and that third party. PriceScout shall not be liable for any loss, damage, or harm arising from your use of or reliance on any third-party website.
The Service, including but not limited to the PriceScout name, logo, owl mascot, tagline ("The owl always finds a better deal"), website design, user interface, software, algorithms, text, graphics, and all other content and materials made available through the Service (collectively, "PriceScout Content"), are the property of PriceScout LLC or its licensors and are protected by United States and international copyright, trademark, trade dress, patent, and other intellectual property laws.
You are granted no right, title, or interest in any PriceScout Content except the limited license to use the Service as expressly set forth in these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any PriceScout Content without our prior written consent.
Product pricing data displayed on the Service is retrieved from third-party retailer websites. PriceScout does not claim ownership of third-party pricing data. Such data is used for comparison and informational purposes in connection with the operation of the Service.
Retailer names, logos, and trademarks displayed on the Service (including but not limited to Amazon, Walmart, Target, Best Buy, and Costco) are the property of their respective owners. Their display on the Service is for identification and informational purposes only and does not imply any endorsement, sponsorship, or affiliation between PriceScout and those retailers unless expressly stated.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PRICESCOUT LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, PriceScout does not warrant or represent that:
You acknowledge and agree that your use of the Service is at your sole risk. Any pricing information, verdict, prediction, or other content obtained through the Service is used at your own discretion and risk, and you will be solely responsible for any purchase decision you make based on information provided by the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PRICESCOUT LLC, ITS OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS (COLLECTIVELY, THE "PRICESCOUT PARTIES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE PRICESCOUT PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS ($100.00).
The limitations of liability set forth in this section apply regardless of the theory of liability, whether based in contract, tort (including negligence), strict liability, warranty, or any other legal or equitable theory, and regardless of whether the PriceScout Parties have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, the liability of the PriceScout Parties shall be limited to the greatest extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless PriceScout LLC and the PriceScout Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law, regulation, or third-party right; or (d) any dispute between you and any third-party retailer. This indemnification obligation shall survive the termination of these Terms and your use of the Service.
Your use of the Service is also governed by our Privacy Policy, available at usepricescout.com/privacy. The Privacy Policy describes how we collect, use, disclose, and protect your information. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
If you voluntarily subscribe to our email newsletter or waitlist, you consent to receive periodic email communications from PriceScout, including promotional content, deal alerts, and product updates. You may unsubscribe at any time by clicking the "unsubscribe" link included in every email or by contacting us at legal@usepricescout.com. We will process your unsubscribe request within ten (10) business days. Even after unsubscribing from promotional communications, we may send you transactional or administrative messages related to the Service.
We may restrict, suspend, or terminate your access to the Service at any time, with or without cause, with or without notice, and without liability to you. You may discontinue your use of the Service at any time. Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 8 (Intellectual Property), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), 17 (Governing Law and Dispute Resolution), and this Section 14.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, temporarily or permanently, with or without notice. This includes, but is not limited to, the addition or removal of supported retailers, changes to the pricing data refresh frequency, modifications to the verdict calculation methodology, updates to the sale event calendar, and the introduction or removal of features. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
If PriceScout offers a browser extension (the "Extension"), your use of the Extension is subject to these Terms in addition to any terms imposed by the platform through which the Extension is distributed (e.g., the Chrome Web Store). In the event of a conflict between these Terms and the platform's terms, the more restrictive provision shall apply. The Extension is provided as an additional access point to the Service and is subject to the same disclaimers, limitations of liability, and other provisions set forth in these Terms.
These Terms and any dispute arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles.
Before initiating any formal legal proceeding, you agree to first contact PriceScout at legal@usepricescout.com and attempt to resolve any dispute informally for a period of at least thirty (30) days. During this period, both parties agree to negotiate in good faith to reach a mutually acceptable resolution.
If informal resolution is unsuccessful, any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in the State of California, and you irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND PRICESCOUT AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than through informal resolution, both you and PriceScout waive any right to a jury trial.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
The failure of PriceScout to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by PriceScout.
These Terms, together with the Privacy Policy and the Affiliate Disclosure, constitute the entire agreement between you and PriceScout regarding your use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Service.
You may not assign or transfer these Terms, or any rights or obligations hereunder, without the prior written consent of PriceScout. PriceScout may freely assign or transfer these Terms, or any rights or obligations hereunder, without restriction. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties, their successors, and permitted assigns.
